Terms & Conditions of Service
These Terms govern your use of the AircraftRenter reservation platform, aircraft dispatch systems, and fleet scheduling services. Please review these operational requirements carefully.
14 CFR § 91.3 Regulatory Notice: Operational Control & Pilot in Command (PIC) Authority
AircraftRenter is exclusively an independent scheduling, reservation, and fleet management software platform. AircraftRenter is not an air carrier, commercial flight operator, flight school, or aircraft maintenance facility. Under 14 CFR § 91.3 (or applicable foreign civil aviation authority regulations), the designated Pilot in Command (PIC) of an aircraft is directly responsible for, and is the final authority as to, the safe operation and airworthiness determination of that aircraft.
Agreement Sections
1. Acceptance of Terms & Scope of Platform
By creating an account, accessing, or utilizing the AircraftRenter platform (the "Platform" or "Service"), you agree to be bound by these Terms & Conditions, along with our Privacy Policy. If you do not agree to all terms, you must refrain from creating an account or reserving any aircraft.
AircraftRenter provides a multi-tenant software system that connects licensed pilots ("Renters" or "Pilots") with aircraft owners, flying clubs, fixed-base operators (FBOs), and flight schools ("Fleet Operators"). AircraftRenter acts solely as a technology provider and does not own, inspect, dispatch, or operate the aircraft listed on the Platform.
3. Pilot Credentials, Medicals, & Checkout Requirements
To reserve or operate aircraft through the Platform, you represent and warrant that:
- You hold a valid, unrevoked Pilot Certificate with category, class, and instrument ratings appropriate for the reserved aircraft make and model.
- You maintain a valid FAA Medical Certificate (or current BasicMed compliance) and satisfy flight review (BFR) requirements pursuant to 14 CFR § 61.56.
- You meet all currency requirements under 14 CFR § 61.57 (takeoffs/landings within preceding 90 days for carrying passengers, day or night).
- You have completed any mandatory make/model checkout, flight school checkout flight, or insurance minimums specified by the relevant Fleet Operator prior to solo flight.
Providing false, misleading, or expired certificate details constitutes grounds for immediate account termination and will void insurance coverage.
4. Pre-Flight Inspection & Airworthiness Obligations
Prior to engine start or taxi, the Renter is legally obligated under 14 CFR § 91.7 to determine whether the aircraft is in condition for safe flight. This includes:
- Verifying aircraft documents (A.R.O.W. - Airworthiness Certificate, Registration, Operating Limitations/POH, Weight & Balance).
- Reviewing maintenance status sheets (Annual, 100-Hour, Pitot-Static/Altimeter, Transponder, ELT battery, and open ADs/squawks).
- Performing a physical walkaround, fuel sumping for contamination, oil level check, and control surface verification according to the aircraft POH checklist.
- Immediately grounding and reporting any aircraft showing unairworthy conditions, leaks, structural defects, or inoperative required equipment.
5. Reservations, Cancellations, & Safety-First Weather Policy
Safety-First Weather Cancellations: AircraftRenter strictly enforces a no-penalty cancellation policy for flights canceled due to adverse weather conditions (marginal VFR/IFR, icing, thunderstorms, gust limits exceeding POH crosswind components). No pilot will be charged cancellation penalties when exercising conservative aeronautical decision-making (ADM).
Unexcused No-Shows: Reservations not canceled at least 2 hours prior to departure without justifiable weather, maintenance, or medical justification may be subject to a scheduling hold fee determined by the hosting Fleet Operator.
6. Hobbs/Tach Meter Logging, Wet vs. Dry Rates, & Fuel Credits
Meter Recording: Rental billing is computed based on starting and ending Hobbs meter readings (or Tachometer hours, depending on operator policy) recorded in the AircraftRenter check-in/check-out workflow. Renters must accurately photograph or log meter times upon completion.
Wet vs. Dry Rates:
- Wet Rates: The hourly rate includes aviation fuel. When purchasing fuel away from home base, fuel costs are reimbursed or credited up to the home base posted fuel rate upon uploading an itemized fuel receipt.
- Dry Rates: The Renter is responsible for paying all fuel consumed directly to the FBO or fueling facility.
7. Aircraft Damage, Insurance Deductibles, & Squawks
Insurance Deductible Responsibility: In the event of an incident, prop strike, hangar rash, hard landing, or loss occurring during the Renter's booking, the Renter is responsible for paying the applicable hull insurance deductible (typically $2,500 – $5,000 depending on the aircraft policy), unless prohibited by local regulation or covered under secondary non-owned aircraft insurance (CFI / Renter insurance).
Mandatory Incident Reporting: Any hard landing, tail strike, engine overspeed, avionics fault, or off-airport precautionary landing must be immediately reported to the Fleet Operator and logged as an aircraft squawk in the AircraftRenter system.
8. Limitation of Liability & Renter Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRCRAFTRENTER AND ITS OFFICERS, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF PROFITS, OR AIRCRAFT DOWNTIME RESULTING FROM:
- The operation, maintenance, mechanical condition, or dispatch of any aircraft listed on the Platform.
- Errors, inaccuracies, or downtime of the scheduling or weight & balance calculator features.
- Actions, omissions, or negligence of any pilot, passenger, flight instructor, or fleet operator.
Indemnification: You agree to defend, indemnify, and hold harmless AircraftRenter against any and all claims, liabilities, damages, losses, or legal expenses arising from your operation of an aircraft, violation of aviation regulations, or breach of these Terms.
9. Account Suspension, Grounding, & Dispute Resolution
AircraftRenter reserves the right to suspend or permanently revoke pilot flight booking privileges for reckless flight conduct, intentional falsification of pilot qualifications or Hobbs times, overdue balances, or violation of operator safety rules.
These Terms are governed by the laws of the jurisdiction where the Fleet Operator is based, without regard to conflict of law principles. Any dispute arising from these terms will be settled through binding arbitration or appropriate small-claims court.
